2. General Information
Protecting your personal data is important to us. We process your data exclusively on the basis of applicable law (GDPR – Regulation (EU) 2016/679, German Federal Data Protection Act – BDSG). This policy explains which data we collect when recruiting drivers/couriers, for which purposes and on which legal basis, to whom we disclose it, and what rights you have.
3. Data We Process
In connection with your application or contact, we process in particular:
- Identity data: first and last name
- Contact data: phone number, email address, and messaging identifiers where applicable (WhatsApp number, Facebook/Instagram profile ID)
- Application data: qualifications, professional experience, driver's licence, work permit/residence status, availability, accommodation needs
- Communication content: messages you send us via our channels (application form, WhatsApp, Facebook Messenger, Instagram Direct, phone, email)
- Documents: documents you submit (e.g. driver's licence, CV)
4. Purposes and Legal Bases
We process your data to carry out the application and selection process, to communicate about a possible employment, and to pre-qualify candidates.
Legal bases are:
- Art. 6(1)(b) GDPR (pre-contractual measures at your request) and § 26 BDSG (establishing an employment relationship)
- Art. 6(1)(a) GDPR (your consent, e.g. when using the application form or for storage for future positions)
- Art. 6(1)(f) GDPR (legitimate interest in efficient candidate communication)
You may withdraw any consent at any time with effect for the future (by email to info@profirlogistik.de). The lawfulness of processing carried out before withdrawal remains unaffected.
5. Communication via Messaging Services (WhatsApp, Facebook Messenger, Instagram)
You can contact us via WhatsApp, Facebook Messenger and Instagram Direct — or, where you have consented or contacted us first, be contacted through these channels. We process the messages you send and associated profile data (e.g. name, phone number, Meta user/page ID).
These services are provided by Meta Platforms Ireland Ltd. (4 Grand Canal Square, Dublin, Ireland). Meta's own privacy terms additionally apply (facebook.com/privacy/policy, whatsapp.com/legal/privacy-policy). Meta may process data outside the EU (USA). The legal basis for our processing is Art. 6(1)(a), (b) and (f) GDPR.
6. Automated Communication / AI Assistant
Initial replies and the pre-qualification of candidates are handled by an AI-assisted assistant ("Veronica"). For this, your message content is processed by our service provider Anthropic to generate suitable replies.
No solely automated decision producing legal effects or similarly significant effects within the meaning of Art. 22 GDPR takes place — hiring decisions are always made by a human. The assistant only serves communication and data intake.
7. Recipients / Processors
To provide our services we use carefully selected providers acting as processors (Art. 28 GDPR) under appropriate agreements:
- Anthropic (AI-assisted reply generation)
- Notion Labs, Inc. (candidate management/CRM)
- Hetzner Online GmbH (server hosting, Germany)
- Meta Platforms Ireland Ltd. (messaging via WhatsApp/Messenger/Instagram)
Any further disclosure to third parties takes place only where legally required or necessary to perform the contract.
8. International Data Transfers
Some of the above providers (Anthropic, Notion, Meta) also process data in the USA. Such transfers are based on appropriate safeguards, in particular EU Standard Contractual Clauses (Art. 46 GDPR) and/or certification under the EU-US Data Privacy Framework. Hetzner processes data in Germany/EU.
9. Storage Period and Deletion
We generally store your application data only for the duration of the selection process. After completion it is deleted within 6 months at the latest, unless you have consented to longer storage for future positions or statutory retention obligations apply.
10. Data Security
We take appropriate technical and organisational measures to protect your data against loss, alteration and unauthorised access. Data transmission on our website is encrypted (HTTPS/TLS).
11. Your Rights
Under the GDPR you have the right to:
- Access to the data stored about you (Art. 15)
- Rectification of inaccurate data (Art. 16)
- Erasure ("right to be forgotten", Art. 17)
- Restriction of processing (Art. 18)
- Data portability (Art. 20)
- Object to processing (Art. 21)
- Withdraw a given consent (Art. 7(3))
